IMPORTANT NOTICE

Flying in general aviation aircraft, participating in flight training, aircraft operations, aircraft maintenance activities, and being present in or around aircraft and airport facilities involve inherent risks that cannot be eliminated regardless of the care taken to avoid injury or loss.

By participating in any activity associated with Countrywide Flyers Cooperative Association, Inc., you acknowledge that you understand these risks and voluntarily agree to the terms of this Liability Waiver and Assumption of Risk Agreement.

If you do not agree with these terms, you must not participate in club activities, access aircraft, or enter operational areas of the hangar or airfield.


1. Assumption of Risk

I understand and acknowledge that aviation activities include, but are not limited to:

• Aircraft operations
• Aircraft rental
• Flight training
• Discovery flights
• Aircraft maintenance and inspection activities
• Ground operations around aircraft
• Boarding and deplaning aircraft
• Fueling aircraft
• Taxiing aircraft
• Operating aircraft in flight
• Exposure to rotating propellers, moving vehicles, and aviation fuel

I understand that aviation activities involve serious risks, including but not limited to:

• Aircraft accidents
• Equipment failure
• Mechanical malfunction
• Weather hazards
• Pilot error
• Air traffic conflicts
• Turbulence
• Hard landings
• Fire hazards
• Property damage
• Serious bodily injury or death

I voluntarily assume all risks, known or unknown, associated with participating in any activity involving aircraft or aviation operations with Countrywide Flyers Cooperative Association, Inc.


2. Release of Liability

In consideration for being permitted to participate in any activity associated with Countrywide Flyers Cooperative Association, Inc., I agree to release, waive, and discharge:

its officers, directors, shareholders, members, instructors, contractors, employees, volunteers, aircraft owners, maintenance providers, and affiliates

from any and all liability, claims, demands, damages, or causes of action that may arise from participation in aviation activities, including but not limited to:

• Personal injury
• Bodily injury
• Death
• Property damage
• Financial loss

This release applies whether the claim arises from negligence or otherwise, to the fullest extent permitted by applicable law.


3. Independent Flight Instructors

Countrywide Flyers Cooperative Association operates as a flying club and aircraft cooperative.

Flight instruction provided to members is conducted by independent Certified Flight Instructors (CFIs) who are not employees or agents of Countrywide Flyers Cooperative Association, Inc.

Each instructor operates independently and under their own professional certification and insurance coverage.

Countrywide Flyers does not supervise, control, or assume liability for the actions of independent flight instructors.

Members and students agree that:

• Instruction is provided independently by the instructor
• The instructor is solely responsible for training decisions and supervision
• Any disputes or claims related to instruction must be directed to the instructor providing the service


4. Aircraft Operations and Rental

Members acknowledge that aircraft operated within the club fleet are privately owned or cooperative assets and may be rented or operated by qualified members in accordance with club policies.

All pilots agree that they will:

• Operate aircraft in accordance with FAA regulations
• Maintain required pilot certificates and medical eligibility
• Comply with all club safety procedures and aircraft operating limitations
• Follow all aircraft checkout and currency requirements

Pilots are solely responsible for ensuring they are qualified, current, and legally authorized to operate the aircraft they fly.


5. Hangar and Airport Safety

The hangar and surrounding operational areas contain numerous hazards including:

• Aircraft movement
• Propellers
• Aviation fuel
• Maintenance equipment
• Aircraft tugs and ground vehicles
• Tools and machinery

All visitors, members, and students agree to:

• Follow all posted safety rules
• Remain clear of aircraft propellers and engines
• Follow instructions from club staff and instructors
• Exercise extreme caution when moving around aircraft

Parents or guardians are responsible for the safety and supervision of any minors present on the premises.


6. Medical Fitness

Participants affirm that they are physically and mentally capable of participating in aviation activities.

Participants further acknowledge that:

• Aviation activities may involve stress, motion, altitude changes, and emergency situations
• Individuals with medical concerns should consult a physician before participating
• Participants must inform instructors of any relevant medical conditions


7. Indemnification

Participants agree to indemnify and hold harmless Countrywide Flyers Cooperative Association, Inc. from any claims, damages, legal actions, or expenses resulting from:

• Participant negligence
• Violation of aviation regulations
• Violation of club policies
• Improper operation of aircraft
• Damage caused to aircraft, equipment, or facilities


8. Property Damage Responsibility

Members and pilots agree they may be financially responsible for damage to aircraft or property caused by:

• Negligence
• Violation of club rules
• Improper aircraft operation
• Failure to follow instructor or maintenance guidance

Additional insurance coverage may be required by the club for pilots and instructors.


9. Photography and Media

Countrywide Flyers Cooperative Association may photograph or record activities within the club for purposes including:

• Marketing
• Social media
• Training documentation
• Promotional materials

Participants grant permission for the use of their image unless they provide written notice requesting exclusion.


10. Governing Law

This agreement shall be governed by the laws of the State of Florida.

Any dispute arising from participation in activities with Countrywide Flyers Cooperative Association shall be resolved in the courts located within the State of Florida.


11. Severability

If any portion of this agreement is found to be unenforceable, the remaining provisions shall remain fully enforceable to the maximum extent permitted by law.


12. Acknowledgment and Agreement

By signing this Liability Waiver, I acknowledge that:

• I have read and fully understand this agreement
• I understand the risks associated with aviation activities
• I voluntarily agree to participate in such activities
• I agree to release Countrywide Flyers Cooperative Association, Inc. from liability to the fullest extent permitted by law
